Prime Property Solutions LLC (also known as “PPS”)

These Terms of Service (“Terms”) govern your access to and use of the services, website, application process, and rent-to-own housing program offered by Prime Property Solutions LLC, also known as PPS (“Company,” “we,” “our,” or “us”).

By accessing our website, submitting information, completing an application, or participating in our rent-to-own program, you agree to be bound by these Terms.

  1. Nature of Services

PPS operates a rent-to-own housing program that may include identifying properties, facilitating rental placement, coordinating future purchase opportunities, and working with property owners, investors, and third-party partners.

We are not a lender, bank, or credit repair agency.
Participation in our program does not guarantee property placement, approval, financing, or future purchase.

Any future purchase opportunity depends on eligibility, financial readiness, and market conditions at the time of potential purchase.

  1. Eligibility

To use our services, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Have legal capacity to enter into agreements
• Consent to verification and screening
• Comply with applicable laws

We reserve the right to approve or deny any applicant at our discretion and in compliance with Fair Housing laws.

  1. Application and Verification

Submission of an application does not create a tenancy or contractual right to housing.

You authorize PPS and its partners to verify information provided, including:

• Credit reports
• Background checks
• Rental history
• Employment and income
• Identity verification
• Public records

We may deny or discontinue processing applications that contain false, incomplete, or misleading information.

Application or verification fees, if charged, are generally non-refundable unless required by law.

  1. Program Structure

PPS may:

• Identify properties for rent-to-own candidates
• Lease properties directly or through affiliates
• Assign or coordinate leases
• Work with investors or sellers
• Prepare agreements outlining rental and future purchase terms

Final agreements governing tenancy or purchase will be separate written contracts executed at the appropriate time. These Terms do not replace lease agreements, option agreements, or purchase contracts.

  1. No Guarantee of Purchase

Participation in any PPS program does not guarantee:

• Approval for a home
• Ability to purchase
• Financing approval
• Future property availability
• Specific pricing
• Credit improvement
• Investment returns

Any future purchase option must be set forth in a separate written agreement.

  1. Payments and Fees

Participants may be required to pay:

• Application or verification fees
• Option fees
• Rent
• Security deposits
• Administrative fees

All payments must be made according to written agreements. Failure to pay required amounts may result in removal from the program or termination of agreements.

  1. Communications Consent

By providing contact information, you consent to receive communications from PPS via:

• Phone
• Text message
• Email
• Automated or prerecorded systems where permitted

You may opt out of non-essential communications, but doing so may affect our ability to process your application or administer the program.

  1. Accuracy of Information

You agree to provide truthful, complete, and current information. Providing false information may result in:

• Application denial
• Removal from program
• Termination of agreements
• Legal action where applicable

  1. Third-Party Services

We may work with third-party providers, including:

• Property owners
• Lenders
• Title companies
• Attorneys
• Screening companies
• Payment processors

We are not responsible for the actions, decisions, or services of third parties.

  1. Website Use

You agree not to:

• Misuse our website
• Attempt unauthorized access
• Upload harmful code
• Use information for unlawful purposes
• Copy or distribute content without permission

We may restrict or terminate access for violations.

  1. Intellectual Property

All content on our website and materials provided by PPS are owned by or licensed to the Company and may not be copied, reproduced, or distributed without permission.

  1. Limitation of Liability

To the fullest extent permitted by law, PPS is not liable for:

• Indirect or consequential damages
• Loss of opportunity
• Housing outcomes
• Financing decisions
• Third-party actions
• Market changes

Our total liability, if any, shall not exceed the amount paid directly to PPS for services.

  1. Indemnification

You agree to indemnify and hold PPS harmless from claims, damages, or losses arising from:

• False information provided
• Violation of these Terms
• Misuse of services
• Breach of agreements

  1. Fair Housing Compliance

PPS complies with all federal, state, and local Fair Housing laws. We do not discriminate based on protected classes.

Program decisions are based on eligibility criteria, verification results, and program requirements.

  1. Termination

We may suspend or terminate access to services at any time if:

• Information provided is inaccurate
• Required steps are not completed
• Agreements are violated
• Conduct is abusive or unlawful
• Program eligibility is not met

Termination does not waive any financial obligations already incurred.

  1. Dispute Resolution

Any disputes shall first be attempted to be resolved informally. If unresolved, disputes may be handled through:

• Mediation
• Arbitration
• Court in the state where the property or Company is located

You agree to the jurisdiction of the state of Delaware unless otherwise required by law.

  1. Modifications

We may update these Terms at any time. Updated Terms will be posted with a revised effective date. Continued use of our services constitutes acceptance.

  1. Entire Agreement

These Terms, along with any signed agreements and the Privacy Policy, constitute the full understanding between you and PPS regarding use of services.
